Here are the details of this case, involving a £50,000 Santander BBL.

On or before 07 July 2020, Mrs Samuel caused Dabenji Healthcare Services Ltd (“Dabenji”) to apply for and obtain a Government backed Bounce Back Loan (“BBL”) for £50,000 to which it was not entitled by providing false or knowingly inaccurate information regarding Dabenji’s turnover in 2019.

In addition, the proceeds of the loan were not used for the economic benefit of the business, contrary to the terms of the BBL.

In that:

  • Eligibility Dabenji was incorporated on 15 April 2019.
  • Dormant accounts were filed for the years ending 30 April 2020 and 30 April 2021.
  • Dabenji opened a bank account with Santander Bank on 27 July 2019 Between 27 July 2019 and 27 June 2020, credits totalling £4,173 were paid into the bank account.
  • These did not relate to business trading.
  • Prior to 09 July 2020 Dabenji applied to Santander Bank for a BBL of £50,000 stating that its turnover was £200,000

Use of funds

  • On 09 July 2020 Dabenji received the BBL of £50,000 into its banks account Between 11 July 2020 and 23 April 2021, payments were made totalling £36,400 to unknown parties.
  • Between 11 July 2020 and 16 September 2021 the Company made payments directly or indirectly via retail stores totalling £16,717 for the benefit of Mrs Samuel.
  • Mrs Samuel has advised the Liquidator in writing that she has not made proper use of the BBL.
  • Mrs Samuel caused or allowed Dabenji to fail to maintain and/or deliver adequate or complete accounting and administrative records to the Liquidator.

In that:

  • Mrs Samuel failed to deliver up any records to the Liquidator.
  • Mrs Samuel has advised the Liquidator in writing that she has not kept proper records.

As a result, it has not been possible:

Determine the payees of payments out totalling £36,400 to unknown parties.
